The Federalist (January 3, 2025) reported that New York County Supreme Court Justice Juan Merchan declined a motion to toss the May 2024 jury verdict and set sentencing before January 20, 2025. The Federalist quoted this sentence from an 18-page ruling: “Finding no legal impediment to sentencing and recognizing that Presidential immunity will likely attach once Defendant takes his Oath of Office, it is incumbent upon this Court to set this matter down for the imposition of sentence prior to January 20, 2025.” That quotation is The Federalist’s excerpt of the order. Daily Wire reported that on the Monday before the hearing Merchan denied a motion to stay the January 10, 2025, sentencing: “Defendant’s motion for a stay of these proceedings, including the sentencing hearing scheduled for January 10, 2025, is hereby DENIED.” Daily Wire attributed that line to Fox News’s account of the order. Again: reporting of a ruling, not a hosted PDF.
