The New York State Unified Court System posted the February 15, 2024, Decision and Order over the name Juan M. Merchan, A.J.S.C. Caption: People of the State of New York against Donald J. Trump, Indictment No. 71543/2023. The official file is on nycourts.gov. A media advisory the same week placed the argument at 100 Centre Street, Criminal Term, Part 59, Room 1530.
The decision recites: on March 30, 2023, the defendant was indicted on thirty-four counts of Falsifying Business Records in the First Degree, Penal Law § 175.10. The invoices, general-ledger entries, and checks, it says, form the basis of those counts. On September 29, 2023, the defense filed omnibus motions, including dismissal for legally defective charges and for pre-indictment delay, plus a demand for a more robust bill of particulars.
On pre-indictment delay, the court applied the Taranovich factors and denied that branch of the motion. That is what the PDF says. This post does not summarize every other branch as if it were quoted. If a reader wants the rest of the holdings, open the file. A later docket order (motion to vacate the March 8, 2024, filing-management order, decided March 26, 2024) recites that the omnibus motion was decided February 15, 2024, and that the trial date had moved to April 15, 2024. Arraignment, that later order says, was April 4, 2023.
